Terms and Conditions
Effective January 1, 2026
Benchmark White Plains Concrete Company, whiteplainsconcretecompany.com, team@whiteplainsconcretecompany.com
Accepting these terms
These terms apply when you use the Benchmark White Plains Concrete Company website, ask us for an estimate or hire us for concrete work. By using the site or booking a job with us, you agree to them, so please read them before you go ahead.
If a written estimate or contract we give you for a specific job says something different from this page, the written estimate or contract wins for that job.
What we do
Benchmark White Plains Concrete Company is a concrete contractor in White Plains, NY. We build driveways, patios, sidewalks, steps, garage floors, retaining walls, slabs, footings and foundations for homes and businesses in White Plains and the cities around it. You can read more about who we are on our About page.
The descriptions, photos and general advice on our home page and the rest of the site are there to help you understand the work. They aren't a quote, a promise of a result on your property or a substitute for an on-site look at your job.
Estimates and pricing
We give free quotes on site, because the price of concrete work depends on things we can only judge in person, like the size of the area, what the old slab sits on, how the water runs and how easy it is to get a truck close. Your estimate will list the work it covers.
An estimate is based on what we can see before the job starts. If we open up the ground and find something nobody could have known about, like soft fill, buried debris, old footings or roots under the old slab, we'll stop, show you and agree on any added cost with you before we do the extra work.
Changes you ask for once the job is underway, such as a bigger area, a different finish or added steps, may change the price and the schedule. We'll tell you what the change costs before we do it.
Scheduling, weather and cancellation
We'll set a start date with you when you book. Concrete can't be poured well in heavy rain, on frozen ground or in some extreme heat, so we may move a pour date when the weather would hurt the slab, and we'll let you know as early as we can.
Delays caused by weather, material supply, permit approvals or other things outside our control aren't a breach of these terms. We'll get back on your job as soon as conditions allow.
If you need to cancel or move your job, please call us at (914) 259-5254 as soon as you know. Concrete and materials are often ordered ahead of the pour, so if you cancel after we've ordered materials or started work, you may owe the costs we've already taken on, as your estimate or contract sets out.
Payment
Your estimate or contract will show what you owe, when each payment is due and whether a deposit is needed before we schedule the work. Please pay on the schedule it gives.
If a payment is late, we may pause work until the account is brought up to date. Any added costs we take on collecting an unpaid balance may be added to what you owe, to the extent New York law allows.
Our work and what concrete can and can't do
We stand behind our work, and we want you happy with it, so if something isn't right, call us and we'll come look. Any written warranty for your job will be in your estimate or contract, and only what's written there applies.
Concrete is a natural material, and small hairline cracks can show up even on a well-built slab because concrete shrinks as it dries and moves with the ground. We cut control joints, grooves that give the slab a planned place to crack, to keep that cracking in straight lines, but we can't promise a slab will never crack. Small shade differences, minor surface marks and hairline cracks aren't defects.
Your part matters too. Keeping off the new slab for the curing time we give you, not using de-icing salt on new concrete and not parking loads heavier than the slab was built for all affect how long it lasts. Damage from ignoring that guidance, from ground movement, tree roots, flooding or freezing water we didn't cause, or from work done by others isn't covered.
Outside of what your written estimate or contract says, the website and our services are provided as they are, without any other warranty, to the extent New York law allows.
Limits on our liability
To the extent New York law allows, Benchmark White Plains Concrete Company isn't liable for indirect or follow-on losses, like lost income, lost use of your property or inconvenience, that come from our work or from your use of this site.
Before we dig, we rely on marked utility lines and on what you tell us about your property. We aren't responsible for damage to underground items that weren't marked or that you didn't tell us about, such as sprinkler lines, invisible pet fences, private drain pipes or landscape lighting.
If we are found liable for something, our total liability is limited to the amount you paid us for the job in question.
Settling a disagreement
If you have a problem with our work or a bill, please talk to us first. Most problems get sorted out quickly once we're standing at the job together, and you can reach us through our Contact page or at (914) 259-5254.
If we can't work it out between us, either of us can suggest mediation before going to court. Any legal claim must be brought in the state or local courts serving Westchester County, New York.
Governing law
These terms, and any job we do for you, are governed by the laws of the State of New York, even if the work is done in another state.
Changes to these terms
We may update these terms from time to time. The version on this page when you book a job is the one that applies to that job, unless your written estimate or contract says otherwise.
If any part of these terms can't be enforced, the rest still applies.
Questions about these terms
If anything here isn't clear, call us at (914) 259-5254 or send us a note through our Contact page, and we'll explain it before you decide anything.
